EverSpark Terms of Service

These Terms of Service (“Terms”) govern access to and use of EverSpark’s software, services, and websites (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.
If you are entering into these Terms on behalf of an educational institution, school district, or other organization, you represent that you have authority to bind that entity to these Terms.
Eligibility
You must be at least 18 years old to access or use the Services. The Services are intended for use by educational professionals and institutions.
Use of the Services
Subject to compliance with these Terms, EverSpark grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your internal educational or administrative purposes.
You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your login credentials.
Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose
- Attempt to gain unauthorized access to the Services or related systems
- Reverse engineer, decompile, or copy any portion of the Services
- Upload or transmit malicious code or harmful content
- Misrepresent your role or affiliation to obtain access or pricing
- Use the Services in a way that interferes with performance or security
Student Data and Privacy
EverSpark processes student data solely on behalf of educational institutions and in accordance with applicable privacy laws, including FERPA. Student data remains under the control of the educational institution at all times.

Subscriptions and Payments
Certain features of the Services may require a paid subscription. Fees, billing terms, and plan details will be disclosed at the time of purchase.
Unless otherwise stated, subscription fees are non-refundable and billed in advance.
Service Availability
EverSpark may perform scheduled maintenance or experience service interruptions due to circumstances beyond reasonable control. We do not guarantee uninterrupted or error-free operation.
Intellectual Property
EverSpark retains all rights, title, and interest in the Services, including all software, designs, and content. These Terms do not grant you ownership of any intellectual property.
You retain ownership of content you submit to the Services.
Termination
You may stop using the Services at any time. EverSpark may suspend or terminate access if you violate these Terms or misuse the Services.
Upon termination, access to the Services will cease and data will be handled in accordance with applicable agreements and privacy policies.
Disclaimer of Warranties
The Services are provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by law.
Limitation of Liability
To the maximum extent permitted by law, EverSpark shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to use of the Services.
Changes to These Terms
EverSpark may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the United States and the state in which EverSpark is headquartered, without regard to conflict of law principles.
